LIBERTY TOWNSHIP, OH (FOX19) -

A Butler County teen convicted of executing a plot to kill his parents will be re-sentenced on Wednesday.

Mitchell Simon, 17, was sentenced to nine years in prison last year for tying his parents' bedroom door shut before starting a fire in their Liberty Township home. The couple was able to escape.

His attorneys won an appeal for re-sentencing after claiming the convictions were for allied offenses.

Simon, who was tried as an adult, pleaded guilty to two counts of attempted aggravated murder and one count of aggravated arson. Prior to the re-sentencing, attorneys will go before a judge in an attempt to withdraw the guilty pleas.
