MIDDLETOWN, OH (FOX19) -

The man accused of videotaping a woman inside a Middletown tanning salon will spend 90 days in jail.

David Ruess, 43, was found guilty of attempted voyeurism and ordered to register as a sex offender on Thursday.

Prosecutors said the Batavia man reached his cell phone over the dividers and recorded the woman in the next tanning booth. The incident happened Oct. 31 at Palm Beach Tan.

The victim told police she was getting dressed when she noticed the phone lifted above the divider.

Ruess was also charged with inducing panic. Middletown Municipal Court Judge Mark Wall found him not guilty on that charge.
