Prosecutor: Child's death punishment enough for mom

Criminal charges won't be filed against a mother whose son accidentally shot and killed himself with a gun he took from her purse, according to Butler County Prosecutor Michael Gmoser.

“The shear enormity and permanency of this loss to the mother far exceeds the power of the state to punish the mother for her inattention under circumstances that should have been obvious to her,” said Gmoser in a statement Wednesday.

3-year-old Marques Green fatally shot himself while playing with the gun on June 11. Gmoser said the mother failed to secure the firearm in her purse and described the incident as a "short lapse in judgement."

After reviewing evidence, a Butler County Grand Jury declined to indict Green's mother on charges of child endangering – the only offense that would have applied under the law, according Gmoser.

The mother had firearm training and a concealed carry permit for the gun.
