New Trial For Convicted Cop?

The Springboro cop convicted Friday of being involved in a 1995 scheme that ended in his wife's death could get a new trial. Emphasis is on the word "could." Jim Barton's attorney says he has evidence that makes the prosecution's key witness look like a liar. The new evidence is coming from a man named Danny Ray Clark. Clark says the star witness, Gary Henson, lied to help investigators revive a cold case. Clark and Henson were card playing partners in jail. FOX 19 wanted to know why Clark is coming forward now. Attorney Jon Paul Rion says, "He was offered nothing for his testimony. He really has no motivation to say anything but the truth except that he doesn't want an innocent person to be sitting in jail." The request for a new trial could be considered by a Warren County judge as soon as today. Jim Barton, a former police lieutenant, was convicted Friday of several charges including complicity to involuntary manslaughter. Prosecutors say he hired two men to scare his wife, but instead the robbery ended in Vickie Barton's shooting death. .
