COVINGTON, KY (FOX19) -

No charges will be filed in a shooting Tuesday in Covington, Kenton County's Commonwealth Attorney announced Friday.

Officers responded to Warren Street near Mergele Court around 9:40 p.m. for a reported shooting.

Once on scene, the property owner said two people entered the house and were subsequently shot, according to Covington police.

A previous resident of the home was returning to retrieve some belongings with one other person. He broke in and was shot by the homeowner, Attorney Rob Sanders said.

Sanders said the property owner and previous tenant have different accounts of the story and therefore, the case is not prosecutable.

Police say there is no evidence to suggest the former tenant was intentionally committing a crime.

Additionally, the homeowner will not be charged for the shooting.
