Judge recuses herself in viral video arrest

CINCINNATI, OH (FOX19) -

Judge Heather Russell had to recuse herself from the case of Charles Harrell because of a comment made on Harrell's Facebook page about her that she saw.

"Your honor at this time, we move for you to recuse yourself,” says Harrell’s Lawyer Will Oswall. “We think there's an appearance of impropriety."

Harrell is also accused of posting specific video and photos on his Facebook page of officers inside the courtroom which is illegal which he’s
fighting in court.

"They got to prove that he took that photo,” says Oswall.

Harrell recently filmed his arrested that was caught on video in Over-The-Rhine on Feb. 6. He claims that a Cincinnati police officer was following him and later confronting him and arresting him for jaywalking. 

A new judge, Richard Bernat, will to decide Harrell's fate for the alleged jaywalking and drug possession.

The next court date is March 10  at 9 a.m.
