Police investigate if OTR fatal shooting was self-defense

OVER THE RHINE, OH (FOX19) -

Cincinnati police said a man who fatally shot another man late Wednesday is claiming self-defense.

Officers responded to a report of a person shot near the intersection of Vine and Green streets just before 10 p.m.

When they arrived, they said they immediately found James Mixon, but resuscitation efforts were unsuccessful.

A person of interest, a man, was taken in for questioning by homicide investigators, said Lt. Tim Brown, the night chief.

The man told officers at the scene he shot Mixon in self-defense during an attempted robbery, police said.

He said he had a license to carry a concealed weapon.

Police recovered the weapon used in the incident, and no additional suspects are being sought, a police spokesman said.

The shooter was released after questioning wrapped up early Thursday.

No charges were filed while police said they continue to investigate.

They said they believe video cameras may have captured the incident and want to view those. They plan to reach out to business owners in the area with footage later this morning.

Once authorities have all the facts and evidence in the case, they will consult with the Hamilton County Prosecutor's Office and determine if charges are warranted.
