In a 2015 custody hearing for Austin Cooper, Robert Richie alleges drug and sexual abuse by the boy’s biological mother, Jessica Cooper.

Austin's father Robert Richie, III said it happened from July 2014 thru May of 2015.

In the documents Richie wrote that he was told by a Warren County CPS investigator, of "heavy drug use in the home."

The home he was referring to was of Jessica Cooper. It also reads that the drugs were being done "while the children were there."

Richie claims were filed in the Warren County Court of Common pleas Juvenile Division, of "possible sexual abuse allegations have happened in her home."

He went on to write quote, "Anytime [Austin] used to return from her home, he wouldn't talk, or communicate with anyone for days. An obvious concern."

As Richie petitioned the court to get custody of Austin, he wrote, "I feel it to be in the better interest of my son to stay with me and his step-mother in a safe, stable environment."

Anna Richie was arraigned Friday on felony child endangerment charges after police said she admitted to putting Austin's leg's in scolding hot water as a punishment.

The 4-year-old died from his injuries.
