Harassment or rule breaking? Man ordered out of mall for saggy pants

SPRINGDALE, OH (FOX19) -

Was it harassment or simply someone not following the rules?

Tru Collins recorded himself inside the Tri-County Mall on Tuesday as he was being confronted by a security guard for not following the mall's dress code. 

The guard ordered the man out of the mall because his pants were saggy. Collins claims the security officer continually harassed him.

In the 12 minute video, you can hear the security guard say "You need to sit the d*** phone down before I f******* break it."

Collins admitted to having his pants low, but can be heard telling the security guard that he pulled up the pants.

Attorney Michele Young told FOX19 NOW that Collins has a case beyond harassment. 

"A private establishment can have a dress code but it can't have a racist, sexist or religious bias," Young said. 

Retired judge Norbert Nadel had a different feeling after watching the video. 

"They hired security guards and want to keep proper order," Nadel said. "If the policies are you got to be dressed appropriately, which means your underwear is not showing and your pants aren't down, I would think that is a reasonable request for businesses."

Tri-County Mall released a statement Wednesday night. 

"Tri-County Mall is currently in the process of conducting a full investigation of the incident," the mall's statement read. "The involved security officer has been suspended pending further investigation."

FOX19 NOW has reached out to Collins and the security guard for comment but have not heard back at this time.
