Lawsuit Against Subway Searches

Civil libertarians file suit against NYC subway searches.

The New York Civil Liberties Union has filed a lawsuit challenging random bag searches in the subway. The lawsuit claims the searches violate the Constitution's ban on illegal searches. And it complains the tactic is useless against potential terrorists. The organization's executive director, Donna Lieberman, calls it "a needle-in-a-haystack approach to law enforcement."

City police have been doing random searches at a rotating group of stations for the last two weeks. Joseph Gehring, one of five subway riders whose names are on the suit, says the liberties of riders are being sacrificed for what he calls a "publicity stunt." Police maintain random searches avoid racial profiling and could deter attackers.
