Killing Man Convicted In 1974 Killing Won't Serve Time

A Toledo judge's ruling has allowed a Texas man to go free just before he was to be sentenced in the killing of another man more than 30 years ago.

The judge ordered the man's release because he said the statute of limitations expired long ago.

The county prosecutor says the judge's decision will hurt the work of cold case squads that investigate unsolved murders.

On Monday, County Judge Charles Wittenberg ordered that David Delacruz be released just before he was to be sentenced for involuntary manslaughter.

He had faced 4 to 25 years in prison for shooting James Hendricks in 1974.

A jury had found Delacruz guilty of involuntary manslaughter in June.

The judge said police did little to find Delacruz after the shooting even though he lived and worked in Texas under his own name.
