Updated 7:16 a.m. Friday:
A Butler County grand jury will decide today if Harvey Johnson will face charges for the murder of Kiva Gazaway.
Johnson was arraigned in court yesterday on charges stemming from the courtroom fight when he attacked the bailiff.
A courtroom scuffle has a high profile murder suspect in more trouble.
Police say Harvey Johnson lunged at a bailiff and grabbed for his gun during a hearing at the Fairfield Municipal Courthouse on Wednesday.
FOX19's Chris Shaw reports that police say if Johnson had got the gun, they are certain he would've opened fire in this courtroom.
This is the same man who told FOX19 in an exclusive interview three weeks ago that because of what he knows about his girlfriend's murder, he's going to be locked up for a long time.
Johnson was brought from the jail to the courthouse in handcuffs, but following policy, they were taken off in the holding cell. From there, Johnson and two other inmates were walked into the courtroom, and Johnson sat in the first seat. Sometime before his arraignment, a bailiff walked by carrying papers about two feet in front them. The bailiff dropped the papers on a desk, and that's when police say Johnson attacked. What happened next was described as chaotic.
Police say Johnson locked both hands on the bailiff's gun but couldn't get it out of the holster. From the floor, three bailiffs and a lawyer wrestled with Johnson until they could cuff him.
Johnson is also accused of killing his girlfriend, Kiva Gazaway, who went missing in April.
A month later, Johnson led police to her body in a wooded area, where they discovered that Gazaway had been strangled. Johnson has not yet been charged in Gazaway's murder.
