DAYTON, Ohio (AP) - A judge in Ohio will hold a hearing on whether to grant a new trial to a woman convicted of killing her month-old daughter by burning the child in a microwave oven.
Montgomery County Common Pleas Court Judge Mary Wiseman in Dayton granted the request Wednesday and scheduled a hearing for Oct. 20. Twenty-eight-year-old China Arnold was sentenced last month to life in prison without parole following her second trial. Her first one ended in a mistrial.
Defense attorneys say a former cellmate who testified that Arnold confessed to the killing has changed her story. They also say they have evidence that points to another person as being responsible.
Prosecutors oppose a new trial. They say the cellmate's trial testimony is credible and her recantation is not. And they say there is no evidence anyone other than Arnold committed the crime.
