CLEARCREEK TOWNSHIP, OH (FOX19) - The father of a 2-month-old boy who died ‘suspiciously,' according to police, is under arrest and charged with murder.
Court documents show Cody Colwell is charged with two counts of murder, felonious assault, and two counts of endangering children.
Clearcreek Township police say his son Cayden Colwell was found unresponsive in his home on State Route 123 April 11 after they received a call about a child not breathing.
Cayden was immediately taken to the Atrium Medical Center. He was taken off life support and died at Cincinnati Children’s Hospital three days later.
Police say Colwell knew his son’s death was being investigated as a possible murder and that he was a suspect and tried to run.
They also revealed the felonious assault charge against Colwell stems from an incident involving a separate child. They did not specify who the child is or any possible relation to Colwell.
A Warren County Grand Jury indicted Colwell Friday and police issued an arrest warrant. He was taken into custody in Lexington, Kentucky Saturday.
Colwell waived extradition in front of a Fayette County, Kentucky judge Monday afternoon, our sister-station WKYT reports.
Records show that Colwell was in the Warren County jail as of Thursday. His arraignment is set for May 8.
“It’s not enough, I want to see him behind bars, forever,” Cayden’s aunt Christal Hipsher said. “But I’m glad he’s caught, I’m glad we know justice will be served. It makes it easier, not better, knowing that now he’ll be behind bars and will stay there. Knowing he won’t be able to enjoy his life, because we won’t be able to enjoy Cayden’s life.”
Police originally called the CT scan they received on Cayden ‘suspicious.’
His family believes Cayden died of shaken baby syndrome, but police never addressed those accusations.
He would have turned 3 months old Sunday.
