Judge to consider new trial for Shayna Hubers

CAMPBELL COUNTY, KY (FOX19) - Campbell County Judge Fred Stine said he will take testimony given Monday under consideration about whether Shayna Hubers will get a new trial.

Hubers was found guilty of killing her on-again-off-again boyfriend, Ryan Poston, back in 2012.

Last year she was sentenced to 40 years in prison.

But now, Hubers' attorney wants a new trial since it was discovered one of the jurors, David Craig, was convicted of a felony more than 20 years ago.

Craig testified on Monday and said he was unaware he was a felon.

"The simple truth of this case is no new evidence has been brought forward, no one has changed their testimony, Shayna Hubers is as much as guilty of being a murderer today as she was the night she murdered my son. She will be a murder till the last day she takes a breath," Poston's stepfather Peter Carter said.

Judge Stine has not given a time frame as to when he will make his decision whether to grant Hubers a new trial.
